The court heard that the 30-year-old defendant had pleaded not guilty to the charge when he appeared before magistrates at an earlier hearing in September.
The court heard from Crown Prosecution Service prosecutor Paul John that Newbury was accused of having assaulted a woman by beating in Herefordshire on May 9 last year.
The court dismissed the charge against Newbury, who is of Longmeadow in Putson, Hereford, as no evidence was offered.
