Day, who was represented at the hearing by defence solicitor Marilena Di Vitantonio, had entered not guilty pleas to both charges at a previous hearing in Hereford in August.
The court heard from prosecutor Paul John that the 28-year-old had been accused of assaulting an adult and a child, who cannot be named for legal reasons, outside Hereford's Brampton Road Stores in the Newton Farm area of the city, between 2pm and 2.34pm on February 26.
The case against Day, who is of Cradley Close in Hereford, was dismissed at the February hearing as no evidence was offered.
